Mobile Terms of Service

The LOVE TO DREAM™ UK mobile message service (the "Service") is operated by LOVE TO DREAM™ (“LOVE TO DREAM™ UK”, “we”, "our" or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time. You agree to review these Mobile Terms periodically to ensure that you are aware of any changes. Your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to LOVE TO DREAM™ UK’s SMS/text messaging service, you agree to receive recurring SMS/text promotional messages from and on behalf of LOVE TO DREAM™ UK through your mobile phone provider to the mobile number you provided, even if your mobile number is registered on the Telephone Preference Service or any other official Do Not Call list. You are also confirming that you are a resident of the UK and over 13 years of age or older.

Description of the Service

Text messages may be sent using an automatic telephone dialling system or other technology.. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up to the Service in order to make any purchases, and your consent in connection with this Service is not a condition of any purchase with LOVE TO DREAM™ UK. Your participation is completely voluntary.

Costs and Message frequency

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your mobile phone provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your mobile phone provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your mobile phone provider.

Mobile Providers; Service not guaranteed

It is your responsibility to determine if your mobile provider supports SMS/text messaging and if your mobile device is capable of receiving SMS/text messages. Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions.  You understand and acknowledge that network services, including but not limited to mobile network services, are outside of our control, and we are not responsible or liable for issues arising from such network services (e.g., delayed or undelivered messages or the security of any messages).

The mobile providers supported by the Service are not liable for delayed or undelivered messages.

Opt-out

You may opt-out of the Service at any time. Text the single keyword command STOP to LoveToDream or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other LOVE TO DREAM™ UK mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

Changes

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

Your Mobile Telephone Number

You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. To the extent permitted by applicable law, you agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

Liability

To the extent permitted by applicable law, you agree that we will not be liable for any losses or damages of any kind arising out of or in connection with any failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Nothing in these Mobile Terms limits or excludes our liability for fraudulent misrepresentation, death or personal injury resulting from our negligence or the negligence of our agents or employees.

Governing Law 

These Mobile Terms are governed by English law, and the courts of England and Wales shall have exclusive jurisdiction.

General

If any provision of these Mobile Terms are unlawful, void or unenforceable, that provision shall be deemed severable. However, the validity and enforceability of other provisions will remain.

Nothing in these Mobile Terms is intended to nor shall it confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 and a person who is not a party to these Mobile Terms has no rights to enforce them.

We may transfer our rights and obligations under these Mobile Terms to any other organisation, including any of our group companies. If this happens, we will ensure that the transfer will not affect your rights under the contract.
